WhatsAppBox is a software product operated by My-Conect Enterprise, a business registered in Kenya under registration number BN-9PCKJ599 ("we", "us" or "the Platform"). These Terms govern this website, merchant dashboard, WhatsApp Business tools, APIs and related services (the "Services"). By creating an account or using the Services, you agree to them for yourself and the business you represent ("Merchant" or "you").
These Terms incorporate our Privacy Policy, Acceptable Use Policy, Data Processing Addendum, Cookie Policy, plan description and order form.
You must be an adult with authority to bind the Merchant and use the Services only for lawful business purposes. Information must be accurate and current. You are responsible for activity by your owners, staff, agents, integrations and API credentials. Protect access tokens and app secrets, apply least privilege, and promptly report suspected compromise.
Services may include inbox, campaigns, templates, contacts, automation, AI, CRM, surveys, catalogues, orders, payment links, tracking, analytics and integrations. Features vary by plan, region and provider availability and may change. These are business communication tools—not telephone, SMS or emergency services.
The Services depend on Meta and WhatsApp products. You must comply with the current WhatsApp Business Messaging Policy, WhatsApp legal resources, technical documentation, commerce rules and template requirements.
You authorize us to transmit instructions and Merchant Data to Meta/WhatsApp on your behalf. You remain responsible for your WhatsApp Business Account, administrators, phone numbers, templates, content, recipients, consent, products and conduct.
Meta or WhatsApp may approve, reject or pause templates; change pricing, limits or functionality; and restrict accounts. We do not control those decisions and do not guarantee approval, delivery, reach, availability, account quality or freedom from restriction.
You may message a person only after obtaining all permissions required by law and WhatsApp policy. Consent must identify your business and expected message categories. Keep evidence, honor opt-outs and blocks promptly, suppress opted-out recipients, and avoid spam or deception.
Business-initiated conversations must use approved templates where required. Free-form messages may be sent only within WhatsApp's permitted customer-service window. Platform safeguards assist but do not replace your obligations.
You retain your content. You grant us a limited licence to host, process, transmit and display it to provide and secure the Services and follow lawful instructions. You represent that you have all rights, notices, lawful bases and permissions needed. You must give customers an accurate privacy notice and handle their rights.
Do not break the law, violate rights, send unsolicited or deceptive communications, impersonate others, facilitate fraud or harm, distribute malware, harvest data without authority, bypass limits or security, access another tenant, use unofficial WhatsApp clients, or offer content or goods prohibited by Meta, WhatsApp or law. Our Acceptable Use Policy applies.
AI output may be inaccurate or inappropriate and is not legal, medical, financial or professional advice. Review outputs before use and maintain human oversight for consequential decisions. Do not submit data unless authorized.
The Merchant—not the Platform, Meta or WhatsApp—is seller of record. Merchants are responsible for product accuracy, pricing, tax, receipts, fulfilment, delivery, returns, refunds, warranties, consumer protection, disputes and licences. Payment providers have separate terms. We do not guarantee transactions.
You must pay applicable subscription, usage, message, credit and transaction charges. Fees may reflect third-party changes. Credits are not cash and are non-transferable unless law requires otherwise. You are responsible for tax and bank charges. Failed payment may cause suspension.
We do not guarantee uninterrupted or error-free operation. Maintenance, networks, providers, enforcement and events outside our control may affect availability. We may limit or suspend access to protect systems or users, comply with law or provider instructions, address misconduct or non-payment, or enforce these Terms.
You may close your account subject to outstanding charges and retention duties. Provisions on payment, confidentiality, ownership, disclaimers, liability and disputes survive termination.
We and our licensors own the Services, software, designs and documentation. WhatsApp and Meta marks belong to their owners; you may not imply endorsement. Each party must protect the other's non-public business, technical and security information and use it only for this relationship, subject to lawful disclosure.
To the maximum extent allowed by law, Services are provided “as is” and “as available”, without implied warranties. We do not warrant message delivery, customer response, sales, template approval, compliance or continued third-party access.
Neither party is liable for indirect, incidental, special, punitive or consequential loss, or lost profit, revenue, goodwill, data or opportunity. Our aggregate liability will not exceed fees paid for the affected Services in the six months before the claim. These limits do not exclude liability that cannot lawfully be limited.
You will defend and indemnify us and our personnel from third-party claims and reasonable costs arising from your data, products, communications, consent practices, unlawful instructions, breach of these Terms, or violation of law or rights.
Unless an order form says otherwise, Kenyan law governs and competent Kenyan courts have exclusive jurisdiction, without limiting mandatory rights. We may update these Terms for legal, security, operational or provider changes, with notice where required. Continued use after the effective date is acceptance.
If a provision is unenforceable, the remainder survives. No failure to enforce is a waiver. These Terms and incorporated documents are the entire agreement for the Services.
